AI & Data Use Statement

At Merch.ai, we use artificial intelligence (“AI”) to help promo professionals work faster and create better presentations, lookbooks, and projects — while keeping your data private and secure. This page explains how our AI features work, what data they use, and what we don’t do with your data.

1. What our AI does in Merch.ai

We use AI in three primary ways:

  1. Curating publicly provided product data 
    • We ingest and clean product data that suppliers make publicly available (e.g., descriptions, colors, pricing fields, images). 
    • AI helps normalize, enrich, and organize this data so you can search and build projects more easily. 
  2. Making product suggestions as you build projects 
    • When you create a project, lookbook, or presentation, AI can suggest relevant products based on your filters, brief, or selections. 
    • You remain fully in control of what you add, remove, or share with your clients. 
  3. Creating lifestyle images from regular product images 
    • Our AI can generate lifestyle visuals using standard product images (e.g., supplier images or your uploaded product shots). 
    • The goal is to help you show realistic “in-use” scenes for the products you’re already working with. 

We do not use AI to secretly mine your customer lists or private CRM data — Merch.ai does not connect to your CRM by design.

2. What data we process

Depending on how you use Merch.ai, we may process:

  • Account data – your name, email address, company, and workspace information. 
  • Workspace content – projects, lookbooks, presentations, product selections, comments, and any files or product images you upload or choose to use in the platform. 
  • Supplier / catalog data – publicly provided product data from suppliers (e.g., specification sheets, product info, images) to power search, filtering, and AI curation. 
  • Usage data – logs and metadata about how you use the app (e.g., features used, timestamps, performance metrics). 
  • Support data – information you share when you contact our support team. 

We do not sell your data to third parties.

3. How AI uses your data

When you use AI features, we may send relevant portions of your data to AI models to:

  • Suggest products when you are building a project. 
  • Create AI lifestyle images based on product visuals. 
  • Improve the accuracy, speed, and safety of our features (e.g., debugging, monitoring for abuse). 

We design our prompts and systems so that models receive only the minimum context necessary to perform the requested action.

4. Training & improvement: what we don’t do

We use multiple large language models (LLMs) and AI providers, and our stack may change over time as we adopt the best available options.

Across all of them:

  • We do not use your customer content to train models.
    That means: 

    • We do not allow third-party LLM providers to train their public models on your workspaces, projects, or presentations. 
    • We do not train our own models on your identifiable customer content (e.g., a specific client’s lookbook or project) without a separate, explicit agreement. 

We may use aggregated and anonymized usage data (for example, overall feature usage patterns or error rates) to understand performance and improve the product, but this does not include your identifiable customer content.

5. Multiple AI/LLM providers

Merch.ai may use a combination of AI providers (LLMs, vision models, and related services). Because this stack is continuously evolving:

  • All communication with AI providers occurs over encrypted channels. 
  • Providers are required to follow industry-standard security and privacy practices. 
  • We send only what’s needed for each request (e.g., a product description, image, or text snippet relevant to your action).

6. Security & access controls

AI-related data is protected under the same controls as the rest of your data in Merch.ai:

  • Encryption in transit and at rest for stored content. 
  • Role-based access control and least-privilege access for our team. 
  • Logging and monitoring of our infrastructure for anomalies or abuse. 
  • Strict internal policies around handling customer content.

7. Safety, quality & human review

AI can sometimes be imperfect or incomplete, especially when interpreting briefs or generating visuals. Because of this:

  • AI outputs in Merch.ai are meant to assist you, not replace your professional judgment. 
  • You are responsible for reviewing AI-generated content and images before sending them to end buyers. 
  • We use guardrails and filters to reduce clearly harmful or inappropriate outputs and we monitor for abuse of our AI features. 

If you encounter problematic or unexpected results, please report them to support@merch.ai so we can investigate and improve.

8. Your choices and controls

You control how AI is used in your workspace:

  • Opting out of features – Certain AI features can be disabled at the workspace or user level (where available). 
  • Data you upload – You decide what product images, projects, and other content you store and process through Merch.ai. 
  • Data deletion – You may request deletion of your content in line with our data retention and privacy policies. 
  • Custom terms – For larger customers, we can support custom terms and stricter configurations (e.g., data residency, additional AI restrictions, or isolated environments).

9. Updates to this statement

We may update this AI & Data Use Statement as our product, infrastructure, or relevant regulations change. When we make material changes, we will:

  • Update the “Last updated” date above, and 
  • Where appropriate, notify admins via email or in-app notifications.
